Prima Facie Script

A script is only words. If you say "Duty exists" but enter no evidence of the relationship (doctor/patient, driver/pedestrian), the judge will strike your script. Script the evidence, not just the rhetoric.

This script creates a presumption. The defendant can argue he had permission (defense), but the prima facie case survives because the facts, taken as true, satisfy the law.
